§ 1. Who can order
- The seller is [Nexo Tech Marcin Łętowski], [address], tax ID (NIP) [NIP], REGON [REGON], entered in the Central Register and Information on Economic Activity (CEIDG). Contact: email info@hexoparts.com and the form on the /en/contact page.
- An order as a private person may be placed by a natural person with a delivery address and an invoice address in a European Union member state. With the order, they give their name, address, a phone number for the courier and briefly describe what the part is for.
- These terms also apply to a business that is a natural person ordering on its NIP but not indicating that the purchase is of a professional nature for it. The invoice is then issued to the NIP.
§ 2. Price, approval and payment
- A private person sees gross prices (including 23% VAT) with delivery to the given address. The price applies for the period given with the quote.
- We check every order from a private person before payment (intended use of the part, prohibited items, feasibility). After approval we email a payment link. We may refuse to accept the order, stating the reason; you then pay nothing.
- We do not accept orders from private persons for:
- parts of weapons and ammunition and items on the Prohibited items list,
- parts and accessories for cars, tractors and other motor vehicles (motorcycles are allowed); this restriction is temporary.
- You pay in advance, before production, using one of the methods shown with the order, within 3 business days of the email confirming that a manufacturing partner will make the part; for a bank transfer the reference is the order number. There is no cash on delivery or cash payment.
- Within 3 business days of the order at the latest we check it and confirm production with a manufacturing partner: you then receive an email with the pro forma invoice and the payment link. Once the payment is booked we confirm acceptance for production by email: the contract is concluded at that moment, and the email contains these Terms in the accepted version. If we do not accept the order, you pay nothing. You receive the invoice (without a tax ID) by email and in the panel.
§ 3. No right of withdrawal
- The part is made according to your file and parameters, that is, to your specification. Therefore you have no right to withdraw from a distance agreement (Article 38(1)(3) of the Polish Act of 30 May 2014 on consumer rights). You acknowledge this when ordering.
- Until the payment is booked you can cancel the order at no cost, because you have not paid anything yet. After that, cancellation is governed by the Terms, § 4.
§ 4. Conformity of the part with the contract (claims)
- We are liable for the conformity of the part with the contract, i.e. with the file, the drawing and the order parameters, for 2 years from receipt. Dimensions without tolerance on the drawing are made to ISO 2768-m; without a PDF drawing we make the part according to the 3D model, and threads, fits and roughness only if they are on the drawing or marked in the form.
- Please check the parts within 5 business days of delivery, because then we can clarify a problem with the manufacturing partner fastest. This is a request, not a deadline: you can report non-conformity throughout the 2-year period.
- You report a claim in the panel in the order or by email. We reply within 14 days. In the event of non-conformity you can demand a remake or repair and, if this is not possible or the non-conformity is significant, a price reduction or withdrawal from the contract.
§ 5. Disputes
- You can use free assistance from a municipal or district consumer ombudsman or the provincial inspectorate of the Trade Inspection, including out-of-court dispute resolution. A consumer from another EU country may contact the European Consumer Centre.
- Matters not regulated here are governed by the Terms (in particular § 11) and Polish law, in particular the Civil Code and the Consumer Rights Act. The choice of Polish law does not deprive you of the protection of the mandatory provisions of your country of habitual residence. These provisions do not limit your statutory rights.
